Victims of Domestic Violence Leave

Fresno State is committed to supporting employees who are victims of domestic violence, sexual assault, or stalking. Eligible employees may take leave to address safety, health, or legal needs related to these situations.

Eligibility

All employees, including Faculty, Staff, and Administrators (MPP), are eligible for Victims of Violence Leave. This leave can be utilized for:
  • Seeking medical attention for injuries caused by domestic violence, sexual assault, or stalking.
  • Obtaining services from a domestic violence shelter, program, or rape crisis center.
  • Receiving psychological counseling.
  • Participating in safety planning and taking other actions to increase safety, including temporary or permanent relocation.
  • Pursuing legal remedies, such as obtaining restraining orders or other court assistance.

Leave Details

Duration: Employees may take up to 12 weeks of leave per calendar year for their own qualifying act of violence. If the leave is to care for a family member who is a victim, the duration may vary based on the specific circumstances.

Paid or Unpaid: Leave may be unpaid; however, employees can use available leave credits (e.g., sick leave, vacation, personal holiday) to remain in paid status.

Confidentiality: All information provided will be kept confidential, except as required by law.

Notification Requirements

Employees should provide reasonable advance notice of the need for leave, when feasible. In emergencies or when advance notice is not possible, notice should be given as soon as practicable.

Documentation

Upon request, employees may need to provide documentation supporting the need for leave, such as:
  • A police report indicating that the employee was a victim.
  • A court order protecting or separating the employee from the perpetrator.
  • Documentation from a medical professional, victim advocate, or counselor.
  • A written statement signed by the employee or an individual acting on the employee’s behalf certifying that the absence is for a purpose authorized under the law.
