Appeals Process

If an employee disagrees with the initial decision regarding an accommodation request, or believes an accommodation was not provided in a timely manner, they have the right seek reconsideration and/or redress. This can be done through one or more of the following options:

Employees Representred by a Union Employees Not Represented by a Union
  • If you are not eligible to file a complaint under a collective bargaining agreement, or if your collective bargaining agreement incorporates the CSU system-wide complaint procedure, please refer to CSU Executive Order 1096 for the complaint procedure.
  • You can also refer to Human Resources Office procedures to file a Discrimination, Harassment or Retaliation Complaint.
External Agencies
Employees also have the option to file complaints with external agencies, including:

Note: Nothing in these procedures should be construed to impede or prohibit a timely filing of an ADA or discrimination complaint with the appropriate external government agency.

Retaliation Protection

Retaliation against an employee for filing a disability accommodation request, or for filing a complaint or appeal with the Human Resources Office, is strictly prohibited.
